Terms of Use — CDL Wizard

These Terms of Use ("Terms") govern your use of the CDL Wizard mobile application ("the app"), published by CDL School Online, LLC ("we", "us", "our"). By downloading or using the app, you agree to these Terms. If you do not agree, do not use the app.

 

1. What the app is

 

CDL Wizard is a study aid that helps you prepare for commercial driver's license (CDL) written knowledge tests through practice questions, practice exams, and pre-trip inspection study material. It is intended for adults preparing for a CDL; you must be at least 18 years old to use the app.

 

2. No account; your data

 

The app does not require an account, and you do not sign up or log in. Your study data (scores, progress, missed questions) is stored only on your device. We do not collect your personal information. 3. Purchases

 

The app is free to download and includes free content. Full access is available as a one-time purchase (not a subscription). All purchases are processed by the Apple App Store or Google Play under their terms — we never receive your payment details. Prices are shown in the app before you buy. Because purchases are one-time, there is nothing to cancel. Refund requests are handled by the app store you purchased from:

If you previously purchased or subscribed in an earlier version of the app, use "Restore Purchases" to regain your access.

 

4. License to use the app

  

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app and its content for your own non-commercial study. You may not copy, redistribute, resell, publish, or create derivative works from the questions, explanations, images, or other app content.

 

5. Acceptable use

  

You agree not to: reverse engineer, decompile, or attempt to extract the source code or question database; use automated means to scrape or copy app content; interfere with or disrupt the app; or use the app for any unlawful purpose.

6. Intellectual property

  

The app, its design, and its content are owned by CDL School Online, LLC or its licensors and are protected by applicable intellectual property laws. These Terms grant you no ownership rights.

 

7. Educational disclaimer — no guarantee of passing

 

CDL Wizard is a study aid only. We do not warrant or guarantee that using the app will result in passing any test or obtaining any license. Always study your state's official CDL manual and rely on official sources. Practice scores in the app do not predict or guarantee official test results.

 

8. Not affiliated with any government agency

 

CDL Wizard is a private study aid. It is not affiliated with, endorsed by, or connected to the FMCSA, any state DMV/DOL, or any other government agency.

 

9. Disclaimer of warranties

  

The app is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. Your use of the app is at your own risk. We do not warrant that the app will be uninterrupted, error-free, or that content is complete or current.

 

10. Limitation of liability

To the maximum extent permitted by law, CDL School Online, LLC and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the app. Our total liability for any claim relating to the app will not exceed the amount you paid for it, if any.

 

11. Changes to the app and these Terms

  

We may update the app and these Terms from time to time. Material changes will be reflected by updating the effective date above. Your continued use of the app after changes take effect means you accept the updated Terms.

 

12. Governing law

 

These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-laws rules. Any dispute will be subject to the exclusive jurisdiction of the state courts located in Washington County, Oregon, or the U.S. District Court in Portland, Oregon.

 

13. App store terms

  

Your use of the app is also subject to the terms of the store you downloaded it from (Apple App Store or Google Play). For apps downloaded from the Apple App Store: this agreement is between you and CDL School Online, LLC only, not Apple; Apple has no obligation to provide maintenance or support for the app; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
